    This Privacy Policy (hereinafter referred to as the “Policy“) regulates relations in the field of https://www.ironshieldukraine.com/ website visitors’ personal data protection (hereinafter referred to as the “Website“), which belongs to the CHARITABLE ORGANIZATION “CHARITABLE FUND “IRON SHIELD OF UKRAINE” (Registration number 44678344; located at: 104 Slobozhanskyi Avenue, apt 125, Dnipro, Ukraine, 49000), registered in accordance with the current legislation of Ukraine (hereinafter referred to as the “Foundation“).

    1. GENERAL PROVISIONS

    1.1 In this Policy, the terms are used with the following meaning:

    • personal data base: a named set of ordered personal data in electronic form and / or in the form of personal data files;
    • personal data subject consent: voluntary expression of the will of an individual (provided they are informed) to grant permission for the processing of their personal data in accordance with the stated purpose of their processing, expressed in a form that allows to draw a conclusion on granting consent;
    • personal data processing: any action or set of actions, such as collection, registration, accumulation, storage, adaptation, modification, renewal, use and distribution (dissemination, sale, transfer), depersonalization, destruction of personal data, including the use of information (automated) systems;
    • personal data: information or a set of data about an individual who is identified or can be specifically identified;
    •  personal data subject: an individual whose personal data is processed; 
    • third party: any person, with the exception of the personal data subject, owner or manager of personal data;
    • cookies: small text files that are stored in the device’s browser (computer, mobile phone, etc.) after visiting the Website, and which the Website transmits to the browser. Additional information about cookies can be found at: https://allaboutcookies.org/.

    All other terms in the Policy are used in the meaning defined by the current legislation of Ukraine, including international legal acts ratified in Ukraine.

    1.2 This Policy is designed to inform personal data subjects about the procedure for processing their personal data when visiting/using the Website, as well as to ensure the protection of their personal data during such processing.

    1.3 This Policy, as well as the Foundation’s activities related to the collection, processing, storage and other lawful actions in relation to personal data, are governed by: 

    • the Constitution of Ukraine;
    • Law of Ukraine “On Protection of Personal Data” of 01.06.2010 №2287-VI;
    • other applicable legal acts of Ukraine that regulate the protection of personal data;
    • international legal acts ratified in Ukraine.

    The legal relations, which the Foundation undertakes in connection with the processing of personal data of foreign jurisdictions residents, are also subject to the law (including international), national and international regulations governing the protection of personal data of residents of such countries.

    1.4 The Foundation is the owner of personal data processed in connection with the visit/use of the Website options. The Foundation has the right to entrust in whole or in part the processing of personal data to third parties on the basis of an agreement concluded in accordance with the requirements of current legislation.

    1.5 An individual is the subject of personal data under this Policy, if they are a visitor to the Website, including if they use any of the options available on the Website.

    1.6 The Foundation guarantees that it:

    • adheres to good practices and regulatory requirements for the protection of personal data;
    • protects the rights of personal data subjects;
    • prevents the risk of violation of the personal data processing security.

    1.7 The purpose of processing personal data obtained during the operation of the Website is the implementation of the Foundation’s statutory activities. 

    1.8 Posting this Policy at the link specified in clause 4.1. of this Policy, is a notification of personal data subjects about the Owner, the composition and content of personal data collected in connection with visiting / using the Website, about the rights of such subjects, the purpose of collecting their personal data and third parties to whom such personal data may be transferred. 


    2. PROCESSING OF PERSONAL DATA

    2.1 The Foundation may collect and process the following information about you:

    • Information you provide to the Foundation: this is information about you that you provide by: using the Website and website options, signing up to receive updates by e-mail, providing charitable assistance (donations) through the website options, communicating with the Foundation through the options available on the Website, etc. 
    • Information about you collected by the Website and other systems: 1) if you visit the Website, third parties may collect certain information about you and your visit, as well as the type and version of your browser, as well as the pages on the Website that you visit, the Internet Protocol (IP) address; 2) The Website may also download cookies to your device; 3) if you are in contact with the Foundation’s employees through the Website or other means of electronic communication.
    • Information collected by third parties about you on the Website through actions: this is information about you that you provide to third parties (for example, Facebook, Google, Twitter), using the social media sharing options available on the Website, when switching from one page to another or by viewing materials that have links (opening) to other platforms (websites).

    2.2 How the Foundation processes your personal data depends on how you use and interact with the Website. Some of the information may be provided directly by you when using the Website or otherwise; other information may be collected and processed by the Foundation independently through automated technologies used on the Website.

    2.3 Legal grounds for data processing: when visiting the Website, the Foundation processes your personal data if 1) the Foundation has received your consent to such processing, 2) your personal data is necessary for the Foundation to enter into and execute a transaction with you or to take measures preceding the conclusion of the transaction, 3) in cases where the Foundation has a legitimate interest in processing your personal data, and this legitimate interest does not override your interests in data protection or your fundamental rights and freedoms, and 4) in other cases as determined by applicable law. In some cases, the Foundation may have a legal obligation to process your personal data or process your personal data for the establishment, exercise or defense of legal claims. 

    2.4 Automated processing mechanisms: The Foundation and third parties may use automated information processing technologies to process information in certain areas of the Website. The Foundation uses cookies to store content and settings, which allows the Foundation to process standard information that your browser sends to certain websites you visit, such as your IP address, browser type and language, as well as the site you came from, the pages you visit and the links you click on the Website. The availability of such technical information helps the Foundation to improve the Website.

    2.5 The Foundation may use your personal data only for the objectives and purposes specified in this Policy and applicable law, in particular (but not limited to), 1) for the purpose of processing your request (appeal) to the Foundation, made through the Website, 2) in order to ensure that you provide charitable assistance (donations) using the options available on the Website, 3) in order to realize other statutory goals of the Foundation in the manner prescribed by applicable law.

    2.6 The Foundation may accumulate personal data processed during your visit/use of the Website, including by entering this data into the personal data base. Storage of your personal data is carried out in compliance with the requirements of current legislation in the field of personal data. 

    2.7 The dissemination of your personal data is carried out solely with your consent or in cases specified in this Policy and applicable law.

    2.8 Your personal data is subject to deletion or destruction in the event of:

    • expiration of the 2-year period of their storage or other period determined by the current legislation; 
    • termination of legal relations between the subject of personal data and the Foundation, unless otherwise provided by law;
    • in other cases, determined by the current legislation in the field of personal data protection.

    2.9 The Foundation does not process personal data on racial or ethnic origin, political, religious or ideological beliefs, membership in political parties and trade unions, criminal convictions, as well as data relating to health, sexual life, biometric or genetic data, except as determined by law.


    3. RIGHTS OF PERSONAL DATA SUBJECTS

    3.1 When visiting/using the Website, you have the right to:

    • receive from the Foundation information not specified in this Policy regarding processing, conditions for granting access to your personal data, or give a corresponding order to obtain this information by persons authorized by you, except as provided by law;
    •  free access to your personal data;
    • receive a response to a request for the processing of your personal data in the manner and within the period specified by applicable law;
    • make a reasoned request with an objection to the processing of your personal data, or to change or destroy your personal data, if such data is processed illegally or is unreliable; 
    • to protect your personal data from unlawful processing and accidental loss, destruction, damage due to intentional concealment, non-provision or untimely provision, as well as to protect against the provision of information that is unreliable or discredits the honor, dignity and business reputation of an individual;
    • withdraw your consent to the processing of personal data;

     as well as to enjoy other rights defined by the current legislation in the field of personal data protection.

    3.2 You have the right to address questions related to the collection, use, storage and other processing of your personal data to the Commissioner for Human Rights of the Verkhovna Rada of Ukraine, who can be contacted via e-mail: [email protected].     4. CHANGES TO THE PRIVACY POLICY
